This Cookie Policy explains how Emotiv, Inc. (“Emotiv,” “we,” “us,” or “our”) uses cookies and similar tracking technologies on our websites and web-based applications, why we use them, and how you can control them. It supplements and should be read alongside the Emotiv Privacy Policy.
Important Scope Note: For telemetry or analytics within native mobile or desktop software applications (such as Emotiv Launcher, EmotivPro, or Cortex API), please refer to the main Emotiv Privacy Policy.
Neural & Health Data Firewall: This policy does not cover EEG data, Neural Data, or Consumer Health Data collected through your Emotiv headset or software. Those data types are governed separately by our Privacy Policy and Consumer Health Data Privacy Policy. We never use tracking cookies or advertising technologies to collect, profile, or target ads based on EEG, Neural, or Consumer Health Data
What These Technologies Are
“Cookies” are small data files placed on your computer or mobile device when you visit a website. We also use related tracking technologies that operate similarly, and throughout this policy, we refer to all of these collective technologies as “cookies”:
Pixels and Web Beacons: Small transparent graphic images or code snippets embedded in web pages or emails that record when a page, email, or feature is viewed or interacted with.
Server-Side Event Tracking: Server-to-server logging that processes user interactions directly on our secure servers based on your privacy preference settings, providing precise analytics without relying solely on client-side browser scripts.

Our Strict Neural Data Safeguard
We explicitly guarantee that no advertising or cross-context tracking cookies are connected to or supplied with EEG data, Neural Data, or Consumer Health Data. We do not build behavioral advertising profiles from neurophysiological telemetry.
Session Replay, Analytics, and Support Tools
To ensure a high-quality user experience, diagnose technical glitches, and protect our platform against fraud and security threats, we utilize session replay and product analytics software on select web properties.
What is recorded: These tools capture interactions such as mouse movements, page clicks, scrolling, screen responses, form field focus, and live support chat interactions.
Data Masking & Privacy: We configure all session replay scripts to automatically mask sensitive inputs—including passwords, payment card details, and personal free-text entries.
Neural Data Exclusion: Session replay tools never record or intercept EEG signals, raw neural metrics, or consumer health telemetry.
Transparency & Control: Where these tools are deployed, we inform you via our initial cookie banner. You may decline functional and analytics cookies at any time without impacting your core access to Emotiv Services.
How to Control and Exercise Your Choices
Emotiv gives you complete control over how non-essential cookies and tracking technologies are deployed on your devices.

Emotiv automatically detects, recognizes, and honors Global Privacy Control (GPC) browser signals. If your browser or browser extension broadcasts a GPC signal:
We treat it as an immediate opt-out request from the "sale" or "sharing" of personal information under applicable US privacy laws.
Where legally applicable (e.g., EEA/UK), we treat it as an automated withdrawal of consent for non-essential cookies.
While traditional browser "Do Not Track" (DNT) headers lack a standardized industry protocol, GPC is fully implemented and enforced across our web properties.
C. European Economic Area (EEA) and United Kingdom (UK) Residents
Under the EU/UK GDPR and ePrivacy Framework:

Service Providers: Some cookies are set on our behalf by vendor organizations (e.g., infrastructure hosting, customer support, web analytics). These vendors are bound by strict legal contracts prohibiting them from using collected data for their own independent purposes.

Expiration and Retention
